I recently applied under 0213. I agree process is not as complicated as it sounds also I am not sure what value add a lawyer will do apart from keying information from you in the forms. My suggestion - do it on your own. You are correct, existing law is not fair but we have no say in this. If and when CIR is passed, this can be repelled or at least relaxed. So instead of wasting energy on these, lets meet lawmakers and educate and push for a CIR that works for everyone. Again don't start another blabbering that CIR is only for illegals etc. It is the only way out at this point or be my guest and wait eternity extending EAD/AP.
Another Example:
Let us say, Employer XYZ has 3 employees on H-1B. Its upto Employer's choice to file green card for any or all of them. Employer may decide to sponsor employment based green card for only 1 of them.
If employer decides to sponsor green card for only 1 of the H-1B worker, can other 2 H-1B workers claim right to get sponsored based on Equal Opportunity Law? The answer is No, since it is perfectly ok and does not come under employment based discremination.
People here are mixing 2 different laws without knowing law's applicability limitations.

How does the House version of SKIL compare blow by blow with the senate provisions for EB in CIR. Does House version of SKIL include recapture of unused visas as well as a raise which was part of the CIR. Compete America report only talks about excluding spouse and depenedents in the House SKIL version for EB visa numbers

Sometimes it suits our purposes and at other times it is vexing. Clearly our issue of legal immigration does not create the type of backlash from conservative republicans that the issue of illegal immigration does. On the other hand when it comes to H1b immigration, every H1b increase has corresponded with some sort of provision(mainly recapture) of EB visas also. H1b increase has tremendous support and pressure from the powerful capitalist forces in this country. Just see how the Wall street Journal and Pres.Bush gives publicity to this issue. I doubt pure EB provisions can get that sort of visibility in spite of the tremendous work of organisations like IV.
In that sense the H1b cap being exhausted indirectly gives our issue more visibility and is a good development. Lets wait until the 20K US masters cap is also filled, then publicity will increase even more.
All in all it looks good that something will work for us by the end of this year. The pressure is building on congress to do something about EB immigration.

It is one way to reduce the budget deficit, each of us will be burning away $700- every year per head for AP + EAD renewal with close to a million applicants go do the maths.
And AP/EAD renewal cannot start before 120 days so that time period every year for at least 3 years they are gonna laugh their guts out.
And we thought we achieved a big feat with the July fiasco ......
USCIS had given one week time to file for I-485 and then closed it. Later after the flower campaign they opened it up for a month. I mean to say, They had opened a small opening for us to get in. Now its our chance of how to get the opening bigger. We were successful by doing a flower campaign. We got to do more. The slot should be made more and more wider and should lead us to green card.

Shame on you for making 55 Indians wait in the airport for more then 12 hrs while the rest of passengers (non-indians) were arranged to go and stay in a hotel. Shame on you for ill treating the passengers in your Country (Paris, France). 1 less customer for you Air France!!! My suggestion: Change your attitude. Don't give substandard treatment to non-white passengers.

At Paris-Charles de Gaulle, under the supervision of competent authorities, checks were carried out on the technical state of the aircraft but no abnormalities were found.
Passengers with a valid transit visa were put up at nearby hotels for the night. Also despite the fact that transit visa�s are issued by the immigration authorities, Air France staff mediated the issuance of visa�s which turned out to be a time consuming process. Needless to say passengers were taken care of by the Air France ground staff who spoke fluent English and passengers were also provided with food and water.
All the passengers were transferred to another Air France aircraft the next day, flight AF 218A which left Paris-Charles de Gaulle at 14:15 and reached Mumbai safely. Air France regrets any and all inconvenience caused to the passengers due to this incident. At all times, the main concern of Air France is to ensure the security of passenger.

My wife had a H1B working for company A from 08/2003 to 07/2005 (from I-94) and she filed another H1B application to work for company B in 05/2004. She got the notice, stopped working for company A and started working for company B. However, she never got the aprroval notice for the second H1B application. Actually this case is currently still pending. She worked for company B until 07/2005 which is the expiration date of the first H1B. She changed to F2 later in 07/2005. I was wondering if there is any problem about status or employment authorization for this period of time from 08/2003 to 07/2005.

I had been there in US for 7 yrs (3 yrs in L2->1yr out of US->4 Yrs in H1B). Saw the myths and tragedy of US GC process very closely. Didn't want to spoil peace of life and my hard earned money with USCIS and lawyers:mad:. Didn�t look at the US GC application and applied for Canadian PR. Came to Canada with PR last year from US. Peacefully settled in Toronto with nice job and benefits, bought my brand new car 4 months back. Nice and friendly people and government. Happy to be in Canada. No more stamping issues, tons of junk paper works, consulate visit PA and wired look from immigration officers at POE�. enough�. I am not going back to US even for a visit in next 5 yrs..�
But I can go out of Canada and enter any time and as many time as I want. Can you do that too???? :D

I have tried to convince people (Indians and some Chinese) to join IV. People don't. They don't believe IV has the capability to get anything done. A lot of people don't care if IV existed or not. They believe that Congress will get to it when it deems right. Core members were asking a few weeks ago if that is the message people are sending. Yes it is.
Yeah. We know that. A lot of people think IV cannot get anything done. IV never promised that we will cause CIR to happen. We never promised that we will cause SKIL to happen. They all happen, mostly on their own. IV's role is to add amendments when they come and remove provisions that hurt us. We did that successfully last year by getting the hard country cap removed. No one else was interested in removing the hard cap. It took a lot of co-ordination and lot of trips and lot of hard work to get it done. If that harmful provision had stayed, then the new quota of 650,000 in S 2611 would have been useless. People forget achivements of IV or think that it was negligible. Retrogression would have been exacerbated with hard country cap.

We know that lot of visitors and members are being squeezed by their situation (exploiting employer, travel restrictions, naggin H4 spouse, no wage growth, no job mobility, no promotions) and that will end only when they get out of H1 and get GC. I am not a leader and I don't want to pretend that I am. I ask others who are not to step down and encourage the right people to take leadership positions.

We already have state-chapters and people are not actively participating in that. Last week, on California's state chapter conf call, 2 people came. If you take leadership, you need to do things locally like meeting with other people in your city, forming a group of 4-5 people and going and meeting your congressman. And if you want to be in IV core, then you have to call us on the phone number listed and we can see if you can add any value to core by doing things we routinely do, like content prep, website maint, travelling to DC for meetings, talking to other orgs etc. If you are up to the job, sure, why not. Anyone who considers themselves fit for IV core, please call us. We really do need help as we are overwhelmed.

The same thing that has caused us to fail last year, the same thing that caused industry to fail in getting H1 quota raised, the same thing that caused failure of Universities to get F4 visa for masters degree holders. And these guys have lobbying budget in millions? Why do you think they failed?
Whatever caused their failure, caused our failure too. In DC, issues are not debated and legislated based on morality and merits of those issues. They are taken up based on contemporary politics and other factors like lobbying, public attention, elections and political parties.
For example: Last year, they debated a constitutional amendment to ban flag burned in USA. And spent precious time of congress on debating it. How to you think that would have helped anyone? Even it had passed, what was the merit of the issue? Flag burned mostly happens outside USA. In USA people rarely burn US flags. So banning flag burning in USA is like banning metric system. Its meaningless. Yet, they spent time on it.
Read papers, read articles from other lobbying orgs and learn something. Legislations dont happen on their own because the issues carry weight and have merits. Merits have nothing to do with congressional action.
To quote a bestselling economist Steven Levitt :
"If morality is how we would like the world to work, economy is how the world actually works".
Same thing applies to US congress. They dont set their timetable of bills based on morality and merits. There are other factors.

A: In my opinion it will move average 2-3 months ahead every month till Sept
08 and Oct 08 should jump it beyound 2004 and by end of Dec 2008 it
should be at 2004- mid "At least".
