    Everyone is saying that "Wait-Wait , have patience , forget Check-cashing till you realize that you've sunk in deep waters"

    If there are few cases which are returned for false reasons ( see other thread) after Aug 17th probably those few will be forgotten till PD becomes Current again - 6-7 yrs - Huh ? :)

    My app was received at the NSC on June 28th at 9:02am. I havent receviced receipts or checks cashed. If for some reason my app is denied or there is a request for evidence after the 17th of Aug are we able to resubmit or will it be too late?

    This would technically mean that anyone anywhere in the world now, who has ever been to the US on a H visa, can apply for a GC based on the first touchdown date.



    Not if the law would say "...currently holding an H1B status" ;)

    I am just hoping we do not mis the July Bus :cool:

    Relax Buddy , now that the bus has come they will keep coming .Most of the people will go in this bus. The dates will retrogress for some time and will be current maybe next year . If not this bus then the next bus . No use raising your blood pressure for this . Attorneys and the media have a habit of scaring people unnecessarily . This Current date is not the end of the world , so take a chill pill ..

    I understand your pain ( I am in the same boat ). EB3-I PD:June 2003. All we can do is keep the struggle going.

    Why should you contribute, because if it wasnt for IV following up with Congresswoman Lofgren, your signature would simply read:

    "PD Date: 03/2003 EB3,i140 aprvd from NSC: 09/2005".

    I am a JUN filer. JUL 07 killed me.

    Last time they needed photos for AP (which I had already sent)

    � I-140 approved 09/04/2007.� I-485 filed on 07/02/2007.
    � Changed jobs on 07/14//2008 (after 1 year of pending I-485)
    � Soft LUD on I-140 02/03/2009 (possible revocation of I-140 from my previous employer)
    � got I-485 denial notice on 02/18/2009
    � filed MTR on 02/27/2009
    � MTR dismissed on 03/26/2009 (on the grounds that I-140 was denied on 09/04/2009)
    � filed second MTR on 04/23/2009
    � soft LUDs on the second MTR on 04/27/2009 and 04/28/2009

    was ur first MTR denied in error?
    as per you, your I-140 was never denied.

    All the data and inside information point to EB2 and EB3 to become current some time in the future.
    Bring every category to C is not a good news at all. That just means the greedy CIS needs more money and wants it now.

    I think I have been very lucky so far. I don't think USCIS processes based on anything concrete, I think it's a little random. Or maybe I am just lucky.

    I applied for PERM in Sep 2006 - EB3 - India.
    I got approved for PERM in Mar 2007.

    I applied for I-140 and I-485 concurrently in Jun 2007.
    I-140 got approved July 20, 2007 and on July 23, 2007 I received all 4 receipts for I-140, I-485, EAD and AP. So my approval came before my receipt. I live in California so everything went to Nebraksa.

    Lawyers emailed saying they also received the EAD card yesterday July 23, 2007.

    Now I have to wait for only AP and Adjustment. And I still have 5 years left on my H1-B (2 years on this visa and then another extension).

    So I say, anything is possible. I wake up every morning and pray to USCIS because they made my life better :) :) :)

    Guys, please continue to leave voice messages, emailing & faxing those idiots at Atlanta PERM center who moved the staff to do other work like processing h2b cases. We need to be persistent if we need any positive outcome. Would those idiots who reassigned staff to do other work, now turn around and help us be reassigining more staff to clear the backlogs? We need to keep questioning them and bombard them with emails, fax and phone calls. It is very important that we act now, if not you all know how delicate of situation we are all finding ourselves in. Please call/email/fax everyone at Atlanta DOL, DOL secratary Elaine Chao and also Assistant Secretary Emily Stover DeRocco.

    ...he encountered a couple of a folks from some universities & concludes that those universities are just crappy....

    By the way, since when 100's of students mean a couple of folks? So far I have taught about 100 such students. And I and my colleagues have been observing problems with such students for over last 5 years or more (about 1000 students). These are not anomalies, rather statistically significant observations.

    And, by the way, (almost) all these students join Indian consulting companies after graduation, which means (at least those) consulting companies care nothing about the quality of the employees. Banning H1-B access to such consulting companies will be of desirable, indeed.

    You are correct, it took around 10 months. From prevailing wage to labor approval. 2 months I mean filing actual labor application to approval.

    Hey you are mentioning that you are in EB3 India with a Priority date of AUG 2004. When did you file for the I-485. To my knowledge it was never until this July Fiasco. Can you please explain.
