My VISA stamped expired long back. I have valid H1 extension and my I94 is valid till October 30 2007. I am in the process of 8 th year H1 extension. Do I need to revalidate my visa to apply I � 485?
I hope lots of us may sail in the same boat. Any answer guys?

I know this must be a issue some of us would have faced. My wife's Birth certificate is in native language. I have got it translated from India on a stamp paper and notarized there itself.
Is this notarized paper a valid birth certificate for 485 ?

Hi,
Background filed H1 extension on Jan 2009 got approved Mar 2009, Got Approved I129 , Got the stamping H1B done in India. Online I129 status was still pending - Ignored that since I got the physical approval notice.
Feb 2009 changed Employer and started working on EAD, on June 3 the online status for I129 has been updated to Denied.
I am checking with my former employer to see if they withdrew my H1 (They typically don't withdraw H1).
I have not filed AC21 with my new employer.
Questions :
1. I have heard of online status still being in pending status even though its been approved. Have anyone heard of its getting denied ?. What are the implications ?.
2. There was a soft touch on my 485 on April 28. and i have not filed for AC21. Should i file AC21 ?

I have been working with company A since Oct 1st 2009. Company A showed location XYZ (which is Vendor's location) on my petition while transfering my H1 in sept 2009.
DHS officer went to location XYZ to verify my employment with company A in Jan 10. At that time I was working with vendor's client at different location. so officer could not able to make any contact neither with vendor nor with me.
Officer sent an email in Aug 10 (this month) to my employer with 5-6 questions to verify my employment.
My current H1 visa is getting expired in Sept 30 2010, so should I continue with my company A?
What are my options? Any suggestions??

My current employer filed my labor and 140 in 2007 under EB3 and are also approved. Now I am planning to move to a different who is willing to start my GC under EB2. Now can i use 2007 as my priority date?

Hi All ,
I am currently on L1B visa valid till Dec 25 2008 and current I-94 valid still July 2009.
I can't apply for I-94 extension until Jan 09.
I am travelling to india on Nov and will return on Nov 30 2008.
Is it advisable to go for Visa Stamping during Nov 08 or can i file my extension once i returned back to US on NOv 30 2008.My visa will be valid only for 25 days and want to know if that will create any issues.
Any views would be greatly appreciated.

My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?

Guys,
Please help me...I do not have much knowledge about GC process. I am working on H1B visa from last 3 years with my current employer and they are ready to apply for GC but, I know that for GC in the same position I cannot use the experience gained during past 3 years. But if I apply for GC for the next level (as GC is for future employment) with the current experience and keep working in my current role until my GC is approved, do you guys see any problem with that? GC approval will easily take 4-5 years and during this time I can keep working in my current position and once GC is approved I can switch to the next level which is kind of promotion.

I have the same situatation and called them numerous times. They say they will honour the actual date that is written on the receipt and not on the web site. When you call USCIS, you have to tell them that your receipt date is different than what is displayed on the web stie.
