Desi employer is not paying for the PTO that I used about 4 months ago. since I'm leaving them in about 2 weeks, they've been delaying this and not paid my PTO. I sent 200+ emails to them.,
I have emails from Employee rerlations managers of the company confirming my available hours and telling me that I would be paid. then endless chains of emails....
I intend to take them to court over this issue. Just wondering if emails in this regard would be sufficient proof of my eligibility and their reluctance for paying my PTO. Is PTO treated same as salary?
I actually went on vacation after confirming with HR that I had PTO in my account. Even after coming back I got emaisl from them that I'll be paid..
Nothing yet after 4 months.
Any suggestions on how to take legal help on this. I've been workign for them for the last 4.5 years.

Your PD is not Current also there is no premium processing for EB2 yet. You can file I140 through your Lawyer.

I have a 4 year Indian Bachelor degree and 5 years of IT experience.
Of my 5 year experience
4 years is for My Company (India) Ltd
1 year is for My Company (US) Ltd.
Will my total experience be treated as progressive and can I process in EB2 category?

I am having a really emergry question that I need help on.

My Husband was a F1 international student and his F1 service had stopped by his school, but his Visa( China) was expires on July, 2009. Couple months ago, he and I gets married and he is ready for file the green card. But his grandfather is very sick now and he have to go back immedately; however, he didn't file anything at this time. If he having a emergry that need to go back on June , what he can do now? And is he able to come back to US?

We have filed an I-130 for our dependant child of my husband who is currently an alien resident. We are trying to figure out how to get a work authorization form started for our son as well as he is old enough to work. We can not figure out how to answer his eligibility catagory. I have filed for 485 /EAD and AP on july 2 2007
receipt date is July 2 2007
Notice date is Aug 29 2007
I see the processing time is 90 day at Texas
I called USCIS and they tell me that they count processing time from the Notice date and not from the date when the case was filed
We have travel plans for this Dec
Can some one pls guide me how and when i can get my AP soon

Folks,
I am trying to put together documents for my wife's 485 application. The birth certificate was re-issued a couple of years back (with corrections to her mother's name and including her last name which was missing earlier).
The lawyer says we need to put a good reason down for 'why a corrected birth certificate was not obtained until now'.
Do you guys know of a good reason to provide USCIS? Know of any reason which was accepted in case of your friends?
Please do advise. Thanks!
