My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.
In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.

What will happen if my renewal EAD is still in the process while my current EAD is going to expire soon (in a week's period)?

Guys ,
Here is my situation. greatly aprecite if you could give some suggestions.
I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
My concerns are...
1. How should the new employer file H1b so that I can join at my wish after oct 2008...??
2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. So wondering If i need to visit and be back before april or is it ok to travel while my new H1b is filed using the presnet i-94..?? that is trvelling sometime In april/May..???

It means nothing. The second 485 was denied since you already have a green card so
Adjustment of Status is not required.

No. Wife's status change is independent of husband. H1 status of husband is not invalidated by wife's use of EAD.

I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

Hello Everyone great community here and very useful information.
Received the email from Cris I-140 approved today.
I just would like to know how long it should generally take for I-485 approval. Now visa's were current when I file I485. What is the status now do I have to wait for visa's to be current again? Sorry for lack of knowledge GC process takes so long sometimes its good to just forget about it :)
Here is the data:
H1 8th year still current :)
EAD 07/07
AP 07/07
PD AUG 2003 EB3 Retro
I-140 Approved Today

I-485 pending since 07/07 ???????????????????

Labor category has little to do with AC21. Your responsibilties should be 'similar', which is kind of a vague term, which means USCIS would generally not mess with anything that has enough of the same words used in description.

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. I was curious if somebody has experience of H1b stamping in dominican republic?
I am planning to go there on a business trip, is it advisable to just go and get it stamped there or should I rather go to canada/mexico and get H1 stamped.
I looked at their website but it's not really very helpful.
