Good morning and thank you for reading my message and considering my question
My attorney has filed an appeal with DOL regarding my prevailing wage, which my state workforce commission rejected (deeming it too low). We were told that we should expect a response from DOL in about 3 weeks, but it has now been close to 10 weeks and we have received no response yet. The attorney is checking with DOL weekly but there has been no response thus far. Is this normal? How long can I expect to wait for a response? Thank you very much in advance for any guidance!

I am on H-1 B , and planning to apply for Labor certification - working for an Automobile manufacturing Company in Engineering department,my qualifications are Bachelor in Mechanical Engineering-SOC CODE (17-2141), Masters in Industrial Engineering SOC CODE(17-2112).

Hi,
My situation -
I am a homemaker on H4 since 2007. ( My husband on H1 ).
Doing MS on H4 ( with few credits still to go )( not full time ).
H4 is due stamping ( Already extended till 2012 ).
Objective -
- To be on F1, to utilize CPT / OPT.
QUESTIONS -
QUESTION - - Which one is better H4 to F1 in US via change of status - I-539 ( BUT That
way i had to face the consulate again for F1 stamping ( Also, very few
credits are left with my MS as in now ))
OR
Directly F1 Visa stamping at
US consulate in India ( It'll be surely fast, that way i won't have to go back for stamping with very few credits left ) ?

� My wife came here on L2 in Aug-2007 and then applied for EAD
� She has been working on EAD since Aug-2007 with Company A
� Company A applied for her GC on 18-Aug-2009 in EB2 while she was still on L2
� Company A applied for H1 which got approved on 08-Oct-2009 till 01-Oct-2012
� We travelled out of US on 10-Dec-2009 and only gave the L2 I-94 on departure, didn�t give H1 I-94
� She got her L2 stamped from India and entered US on L2 on 03-Jan-2010
Please let us know the following:
� Is there any potential of her H1 getting cancelled because she entered back on L2?

You Should say "YES" and produce all the court records.
2) Can I travel & enter US without any issues ? Do I need to carry the expungement letter with me all times entering US?
I would advise not to travel unless you get an attorney to review all your documents and get a confirmation that you are not subjected to any bar under Sec 212 of the INA.
3) Does my arrest go to FBI ? Will I be asked for interview when my PD becomes current ?
You could called in for an interview. But there shouldn't be any problem once you have all the records.
4) What should I beware ?

Folks,
We received letter from USCIS NSC saying that our AP (incl. my spouse) were approved on 10/15/08. On 11/17/08 we received RFE on my spouse AP application for photos. My wife had already left for India (11/15/08) assuming that our AP was approved. Anyways.
My question - If NSC approves her AP application (again), which date will she have on her approved AP application (i.e will the date be still 10/15/08 OR after the RFE response for photos). Photos were received at the NSC on 11/26/08.
Is anyone in the same situation. Your input is much appreciated.

My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:
Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.
Please guide me through the process and any scenarios. Thank you in advance.

Here is my situation. greatly aprecite if you could give some suggestions.
I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
My concerns are...
1. How should the new employer file H1b so that I can join at my wish after oct 2008...??
2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. So wondering If i need to visit and be back before april or is it ok to travel while my new H1b is filed using the presnet i-94..?? that is trvelling sometime In april/May..???

I'm on F1 visa and recently got married in US..I would like to have my lastname changed in my INDIAN passport.. I will apply for a new INDIAN passport through indian embassy in US..I realized that i will get a new passport with new last name...But my question is what happens to the F1 visa on the old passport and I-94, will they be still valid?...How does it work..what do i need to get them moved over to the new passport...
I know i will have to let my school know about the name change so that they can get me a new I-20 by updating the SEVIS...I've already done that and they are OK with it...

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..
