My company HR received a letter from PBEC questioning the existence of our company. This is another step in the bureaucratic ladder of PBEC. First the 45-day letter to signal the intent to continue the petition, then proof of company. I wonder how PBEC thinks the LCA made it all the way to federal without anybody verifying the employer details. HR manager sent the company charter to PBEC to prove the company exists. I left my GC sponser employer 3 months ago and joined new employer on EAD. I spoke to the new company's attorney to file H1B after 2 months of joining. She said that since I have completed 6 years of my H1B so it does not matter if I am on H1B or on EAD as none of them will provide safety net if something goes wrong on 485. Suddenly, after 15 days, I got an email from my Lawyers's office saying that my new company has given permission to them to apply a H1B extn for me and asked me to send the required docs. I am not sure what prompted them to apply my H1B as I had already given up H1B thing and was happy with EAD. I dont know, it might be something to do with charging fee from my new employer or something. Bottomline is no one knows about it and may be even USCIS might not have this scenario in their rule book.
One more thing, in one of the conversations with my new attorney, she mentioned that I can still work on EAD if 485 gets denied because of AC21 reason and MTR has been sent. She said, unless, 485 is denied because of some criminal reason, u can continue working during the MTR period. so another twist??
Maybe we should get it from the horse's mouth and I am sure it is not easy because USCIS will not admit that 485s get denied when invoking AC21

I am still not sure, if its considered 8+2=10 months to complete the PERM labor or we should just consider 2 months from start. Every application should go through the first part of it ( in this case 8 months). Right?

Do all agree that "bridge bill" is the only real helpful measure for us? Or you can show us some other ways?
I mean let's set at least one goal!
After that we can establish what we have, and how we can make it real.
Anyway, it might be quite difficult to organise such a work group, because the majourity of schedule A are outside the US, and on CP... But we all have our emploiers and attorneis who could help us to lobby our interests in the US.

My wife is a RN just passed her NCLEX from Texas. She studied in US. Looking for a sponsor. Asked one of them and they replied there is no H1 for Nurses, you have to be a BSN to be sponsored. Time is bad for nurses after Schedule A quota is over.

Both me and My wife were really impressed by the excellent work IV has done and achieved. I have made a contribution (albeit small) in the past, and will very much like to sign up for recurring contributions. We pledge to contribute $50 monthly as soon as my Wife gets her EAD. We were intending to signup for $20/month right away, to upgrade to $50/month on getting her EAD but I do not see that option anymore.
Anyways, my pledge still stands effective on the day we receive my wife's EAD.

I am exactly in the same situation. Sometimes I feel that I should just dump the EB3 application (PD: 12/04) and start a brand new EB2. Maybe the EB2 PD of say 12/08 will end up to be better than EB3 12/04.
I believe everyone is thinking in the same direction... but if and only if we're able to come out of the blackhole called I-140.

One question I am not clear is:
I am on H1-B. I don't intend to change my status.
I start my LLC & work part time in the LLC on EAD. Is this possible ?
I am not sure if H1 gets invalidated by doing this. If so, the only alternative I found is hire others to do it or open a partnership LLC.
Am I correct ?

Thanks Trueguy, I hadnt counted for the full financial year but had taken a small sample.
The only things which give me hope on Eb2 I are:
a) Eb2 I has always consistently moved forward but last year they had keep moving it backward in the first 6 months
b)Even then in Apr 2008 Eb2 I recovered from U to Dec 03
c) In Jul 08 and Aug 08 Eb3 ROW became U but Eb2 I increased all the way to mid 06
Assuming they use up all the numbers this year i just cant see how Eb2 I can retrogress.
(Big Assumption)

A lot of EB3's got EAD's out of turn. They are the ones who have created the EB3 backlog and also EB2 backlog.
Stop pointing your dirty fingers at handful of EB3->EB2 converts!
Ask them to surrender their EAD's first and then preach others about EB3->EB2 conversions!
