    If you e-filed and no FP notice then you won't be getting EAD in 90 days.

    The day you get FP notice from that at least two weeks after FP will be scheduled. After FP it takes 2 weeks to further processed (Card + approval).

    Although USCIS says to contact after 90 days, you should think in terms of getting infopass.

    Could anyone else provide some more input?

    Mine is paper based. Does anyone know how long it takes when its paper based?

    What it means is there is no need to vote to "lay on table". The presiding officer decides to "lay on table"

    First off it is quite frustrating with people not participating and not putting their money where their mouth is. However, on a constructive note, screaming at people for behaving the way they are behaving rarely gets them to meekly surrender and start doing the right thing. Whether people do it out of their own free will or after persuasion, it take courage for people to participate. What works is to look at the problem and not to personalize the issue. So poor participation is the issue. If you are consistently not getting enough people to attend then it makes sense to delay the frequency of the meetings as one option. The other option is to call people and ask why they were unable to attend and give them a chance to come for the next meeting. Maybe the projection of rounding up x people was based on poor assumptions. So setting realistic expectations and then building momentum from there is the key. This is a dry tough fight. We need to set up tangible goals which break the vision down yet show the grassroot level people how the baby steps will lead to success. Most people in my opinion, back off because they do not see a realistic connection between the baby steps and the final vision. I think if we treat this like a challenge and try to understand the underlying problems, this movement will have a better chance at success. Regards, JH

    FYI:

    - I heard from my friends that their's approved within a month and they did regular paper filing.

    - e-Filing needs ASC appointment for Bio stuff; Looks like, that delays atleast few weeks than paper filing.

    - And, lot of us are waiting for 2 Yr EAD if EAD is not required ot apply before June 30th. That reduces the load too.

    It is one way to reduce the budget deficit, each of us will be burning away $700- every year per head for AP + EAD renewal with close to a million applicants go do the maths.

    And AP/EAD renewal cannot start before 120 days so that time period every year for at least 3 years they are gonna laugh their guts out.

    And we thought we achieved a big feat with the July fiasco ......


    USCIS had given one week time to file for I-485 and then closed it. Later after the flower campaign they opened it up for a month. I mean to say, They had opened a small opening for us to get in. Now its our chance of how to get the opening bigger. We were successful by doing a flower campaign. We got to do more. The slot should be made more and more wider and should lead us to green card.

    They have said that country of chargeability is not assigned until case is ready for approval. However, whether or not a case is ready for approval is determined by country of chargeability.

    I think pre-adjudication solves this catch-22 situation, and they have been pre-adjudicating quite a bit over the past two years. So, I dont think that this is an issue.

    To pbojja, your post shows how you may have completely misconstrued my post. I haven't written the post out of frustration of not being EB-1/2 at all. And am I dreaming when I hear you say that good English speaking skills aren't important in the U.S? Maybe I am in another world. I said clearly that the 'fraud' desi firms and their employees have tarnished India's image. They should be removed from the system and we should be in line with 'genuine' cases. What's wrong with that? Where's the unfairness here?

    To snathan, I understand your post but I believe the tone should be more friendly and amiable. And I certainly didn't give you any red dots so peace on that front. I don't believe in petty playground politics. Actually I appreciate you reminding people about contributions since they are needed a lot for our efforts.

    Also, I can see my profile turned red since people haven't understood the essence of my posts. Very sad situation indeed.

    One way to think is; this forum is for people who want to do something about their state of affairs, and don't just hope that other's would fix the world for them.

    if one has this attitude, then only confidence left to loose is one's own.

    The other way to think is, damn, i gave $50 and still nothing happened.....in this case, let's hope Santa Claus are for real.


    ok, i am beginning to lose confidence now... first no i-485 relief and now wait till CIR>.....last year, CIR turned out to be a big circus....i hope this time something productive happens....

    I filed my labor twice with Fragomen and got rejected in 2001 and 2002.
    Just for H1B visa extension they took more than 9 months. Although they have all my papers for months. Eventually, I had to leave my employer for good.

    Stay away from them if you have choice.

    In my case they took 10 months to file my labor back in 2001. Instead of filing my case in June 2001, they filed my LC only in the middle of Feb 2002.

    Also they never provide any update. Whenever you call them, they are always away from the desk and wanted us to leave a message. Even if you leave a message you don't expect any response from them.

    When my I-140 was approved back in 2006, they filed my 7th year H1 extension. They chose 1 yr extension instead of 3 yrs. I pointed out that mistake 3 times and i never singed the form till they corrected it. It took four attempts to file my H1b extension.

    I hear some people saying childish things like hijacking this thread if anybody says anything different from what they say. What do you prefer, should I open another thread with title "oppose prefiling AOS", nobody wins neither will I or you when somebody does that. Please tolerate others views then they will tolerate yours.

    Without strengthening AC21 if you allow everyone to file AOS then anti eb folks like Grassley, Sanders, Sessions, Durbin will move from targeting H1b to targeting EAD. It takes 6 months to get Perm approval, with pre filing AOS everyone can get EAD in 6 months, anti eb folks and USCIS know that people will be jumping to EAD to escape H1 crackdown, what do you think they will do, they will add amendments and Bills to put restrictions on hiring EAD just like they put restrictions on hiring H1b. We cannot make EAD into another H1b like hell.

    Prefiling should be done to give relief to people who missed July fiasco only after
    1. Remove\dilute same similar job requirement
    2. Make sure EAD is extended without any rfe. USCIS will invent thousand things to issue rfe, EAD should be in a different league to h1 and it should not turn into another h1 where you are slapped with rfe left right and center. Example Pay stub rfe, ability to pay rfe, customer Purchase order RFE etc etc etc, Green card holders don’t have any problem working in these same jobs so why should EAD people face this nonsense (otherwise it is just like h1). Before people complain this will become like a green card, lets me answer in advance, if a person from ROW can get his green card within 12 months of coming to US, why cannot people from India\china who have worked in US for the last 5 to 10 years get the above mentioned relief on EAD. EAD should be superior to h1.the only restriction should be you should work in the same field, i.e. if your labor certification is for Software engineer, programmer analyst etc , then you work in a software related job and cannot become a greeter in walmart :-)

    Without strengthening EAD\AC21 with the above mentioned items you are turning EAD into just another h1.If we push for prefiling AOS without strengthening Ac21 it is a big disadvantage and slap on the face for all the people with older priority date. Because of July fiasco when everybody got current and filed for AOS, USCIS issued GC to people from 2006 leaving behind people from 2003, 04 and 05. USCIS should have gradually moved the dates from 2003 to 04 to 05 that way people with older PD would have got it first. With prefiling AOS it will become a lottery like in August 2008 where 2006 PD got GC over 03,04 and 05 in eb2. Safeguards have to be put in place for order of priority date otherwise USCIS will indulge in this lottery mode and excuse there behavior by claiming they did this to save visa wastage.

    I hate to say this and I hope I am wrong. All of us EB3 folks need to start speaking up or else our fate is sealed. I do not see any hopes of CIR passing. There is always going to be some political backlash due to the AMNESTY factor.
    From what I have seen, most employers are now filing only in EB2 category. They know that filing in EB3 will see their applicants backlogged so severly that there is no hope in seeing their applications approved. So, even those with less than 5 years of experience create resumes that show 5 years to qualify for EB2. Imagine the flood of applicants in EB2 that will pour in when the dates move forward beyond July 2007. There will be a new backlog of EB2 numbers that we have to wait behind. When are we going to get our turn?
    With nearly 10 years of experience and a master's degree, I am still languishing behind all these new comers who come here with fake experiences to qualify for EB2.
    We EB3 folks need to speak up, and have the spill over given to the oldest filed applications IRRESPECTIVE of category. The spillover rules from what I know were defined at a later stage and not as per the original law. If we cannot get CIR passed nor a piecemeal regulation, at least let us get the spillover changed.
    Or, let us en masse transfer to EB2 by porting, thereby making us all eligible for GC ahead of those that are coming in through the back door. I see them as no different from the undocumented immigrants. Breaking the ethical law at the expense of those of us who followed the law. Our positions did not require a Master's degree and I dont see why a programming position today still requires such. I also dont see why our experience today should not count towards qualifying for EB2.
    I dont care what or how many reds the EB2 folks give, but the fact of the matter is that we EB3 must join hands.

    as far as i know -> if spouse is working on EAD, she is NO LONGER on H4.
    and the agreed way of re-instating h1/h4 is via H1/h4 extension or amendment or via h1/h4 stamping.

    if she leaves US and wanna come back , then she can use AP.

    if she still has a valid h4 stamping in the passport, i guess she may be tempted to use it; but i dont know what the implications cud be at the POE. the IO can chk her SSN and find out easily that she is on payroll at employment and paying taxes etc and can question "well it seems like u were working, and now u want to come back to H4? did u quit ur job etc etc". im just guessing but these cud be very valid questions.

    assuming her h4 is accpted at POE, then she comes back to h4 nonimmig visa and is immediately not eligible to work.
    One may say that - oh ok, now taht im back in the US, let me use EAD again and get back to work. but this becomes like flipfloping and just misusing H4 for travel purposes.

    it may be a grey area, chk with a lawyer regarding this. who knows theoritically it may be allowed to flipflop between h4 and ead.
