    I did not say all of the dems, by same token not all republicans support immigration (legal or otherwise).

    What I am saying is that generally, republicans have (even if it is to spite the efforts of people pushing illegal immigration) been more supportive of legal than illegal immigration.

    While many democrats have been supportive, the one of the main reasons for the delay are the dems themselves, their crappy CHC, who dont want to allow any immigration bill till the illegals are elevated on the pedestal. The Dem leadership have put the immigration issue a hostage to the whims of CHC.

    I still can't connect Republicans with legal immigration. I was asking before, what Republican sponsored bill was passed that supports legal immigrants?

    My understanding is that Republicans are generally anti-immigration, whether legal or illegal, while Democrats are generally pro-immigration, whether legal or illegal.

    I think Republicans are pure lip-service but we can't see any action from them. They say they support legal immigration but you cannot see them passing a single bill to put it into action. Even Bush was not able to push Republicans to support CIR. McCain was forced to disavow his support for CIR just to win the nomination.

    On the other hand, it was always at the time of a Democrat President when immigrants had freedoms. VB was almost always current. You can get driver's license easily.

    Again, going back to the question, what Republican Bill was passed in support of us, legal immigrants?

    I am a Person of Indian Origin. I have a slate-grey passport-like document issued by the Indian government that says so. But I�m not really. I was not born or brought up here, and I do not have a single direct ancestor who, as far as I know, ever lived in India. I have become the proud possessor of a Persons of Indian Origin card because I am married to an Indian citizen.

    I had lived in India, on and off, for ten years�and had been married to an Indian citizen for even longer.
    Two men were seated at the edge of the sofa, looking more nervous than me. Shireen was questioning them.


    Previously, my visas were renewed every six months. We now wanted to stay in India indefinitely and make our home in Delhi. I would have preferred dual citizenship�but that wasn�t, and still isn�t, available. PIO would be second best. But the actual card was not easy to come by. It involved a total of 17 visits to three separate ministries and five different offices. It took up at least four full days of my life. I was interviewed twice, the second time at home with my wife, Shireen. The first time was at the offices of the Foreigners Division, Ministry of Home Affairs, in an unventilated, very public room brimming with non-Indians from every continent. I reached the head of the queue after two hours of eavesdropping on other people�s immigration problems. I was asked, among other more prosaic questions, to explain why I had married an Indian woman (�Love,� I said, monosyllabically), and then, with a leer and a twinkle, whether I had had many Indian girlfriends. �N-no�, I stuttered. My hesitant response did not reflect either uncertainty or mendacity on my part, but my surprise and my growing irritation with the questioner. The interview ended abruptly. He wrote �Refer for further enquiry� on my residence permit and said I would receive a home visit. �We need to be sure that marriages to Indian citizens are genuine.�

    Several weeks later, one Friday afternoon around 5 pm, I received a phone call as I was pottering around the streets of central Delhi.
    �He wanted a bribe, you idiot,� my friend said. �You�ll never get your card now; he�d have been happy with Rs 100.�


    The investigators from the Home Ministry would be at my home at 5.30. As I rushed home, images of Mr and Mrs, a television programme of my UK childhood, flashed through my mind. A gormless husband would be placed in a soundproof booth, while his bright-as-a-button wife would stand on the stage. She would be asked semi-intimate questions about their life together: what was the first present she gave him when they were ? What colour nightclothes was she wearing yesterday? And so on. The husband was then released from the booth, and would invariably get the answers wrong, to his embarrassment and everyone else�s amusement. It was gentle viewing�a mild celebration of female omniscience and male autism. But now I was going to take part in a real-life version of Mr and Mrs, and my precious PIO card, and perhaps my right to stay in India, would depend on it. And, suddenly I could not, for the life of me, remember the colour of Shireen�s toothbrush, or the name of her favourite Hindi movie, or her shoe size. Fifteen years of marriage had been erased from my memory. I was sweating with nerves by the time I reached home.

    Two men were seated on the edge of the sofa, looking even more nervous than me, untouched glasses of water in front of them. Shireen was questioning them about their professional qualifications�which were not very extensive. I gave her a self-conscious kiss on the cheek and sat down. At that point, our children burst in, a dancing duet of carefree excitement.

    �What are these children?� asked the chief investigator.

    �They�re ours.� Shireen responded with a slight chill in her voice.

    �Children of both of you? They are very old.�

    �Yes, both of us. They�re twelve and eleven.�

    �How do you have children if you are just married?� I had not prepared for this baffling line of questioning�and was later reprimanded for just sitting there with my mouth open. Shireen, meanwhile, delivered a crushing blow.

    �Ridiculous (sotto voce).... This is all totally ridiculous (out loud).... We�ve been married for fifteen years.�

    I nodded eagerly.

    The two men looked at each other, aghast, and then started scrabbling through the cardboard file they had brought with them. It became clear that they normally interviewed newly-married couples.

    �Can we see your marriage certificate?� I showed it to them and was asked for a copy. I printed out a copy of the certificate, which was downloaded on my computer. They then got up and left�abruptly ending my brief cameo on Mr and Mrs�having promised a decision within two weeks.

    The following evening, a Saturday, our cook, Pan Singh, said one of the men who had come yesterday was at the gate, asking for a lifafa, the Hindi word for envelope. I asked him to invite the man in. Pan Singh returned, a little sheepish, saying the man refused to come in, but just wanted a lifafa�with our marriage certificate. And so, slightly puzzled, I printed out another copy.

    Later, I told a friend this story. �He wanted a bribe, you idiot. A lifafa is what you put the bribe in. You�ll never get your PIO card now, and he�d have been perfectly happy with 100 rupees.�

    Three weeks later I went to the Foreigners� Regional Registration Office to hear the good news, and the bad. �Your application for a PIO has successfully passed the enquiry stage,� the official informed me without looking up. �But unfortunately, Mr Miller, all your documentation has gone astray and you will need to resubmit.� I looked heavenwards and brought my hand down rather heavily on the table. �I�m sorry. We�re not computerised yet, and some of our agents are a little careless.� It may have been my imagination, but I�m sure I detected the trace of a wink in her left eye. �Probably best to apply next time you�re in London,� she told me cheerfully. I walked away presuming, but unable to prove, that my papers had been deliberately lost.

    I took her advice. Three weeks after putting in my application to the Indian High Commission in London (no interview necessary), I had my precious PIO card�together with a 15-year visa, the right to buy property in India, and, to my amusement, the ability to join the diplomats� queue at immigration at Delhi airport. This is of no practical use, because I still have to wait just as long for my luggage, but I do get childishly gleeful as I saunter past the first-class passengers.

    Thanks. I do have my EAD. Just fearful that since I wont be at the 6 month period, I wont get to portability.
    Does US immigration check up on this stuff? If so, how? I'm thinking that the Texas processing center (where my info is being processed) is too busy working on my papers (and other folks' papers) rather than inquiring about everyone's employment status. Is this wishful thinking?

    It does not matter. According to the law, you can invoke AC21 after six months of I-485. Also GC is for future employment. So if the company does not withdraw I-140 petition, you can always go back to them when the GC is approved finally.

    Make sure your employer does not withdraw I-140. Ask your attorney to send you the approved I-140 petition. And switch jobs after six months of I-485 and notify USCIS of the job change. You should be set. Thank AC21 for that.

    Also you should prepare for the eventuality that I-140 gets an RFE. I do not know what your recourse would be then. Better to consult an immigration attorney. May be you can start second PERM, I-140 with your new employer. Good luck.

    Another Example:
    Let us say, Employer XYZ has 3 employees on H-1B. Its upto Employer's choice to file green card for any or all of them. Employer may decide to sponsor employment based green card for only 1 of them.

    If employer decides to sponsor green card for only 1 of the H-1B worker, can other 2 H-1B workers claim right to get sponsored based on Equal Opportunity Law? The answer is No, since it is perfectly ok and does not come under employment based discremination.

    People here are mixing 2 different laws without knowing law's applicability limitations.

    LOL - they will set up a BEC for FOIA requests...

    Paying money for something that will give us results is fine (although I strongly feel this information should be free for whoever requests - that is the whole point of FOIA), but paying for something that has no commitment from USCIS to any date's is in my view throwing away money for their pizza parties or whatever else they do over there besides work.

    Depends on the situation one is in .. May be they wont leave seeing this bulliten but may be forced to go back after a few more ..

    What I dont understand is , is it really the case , all labours being approved in back log centers are really being used for original applicants .. I think very less percentage of them exist in those companys for so many years. If they do they should get VISAS.. but I doubt.

    What happend to recently proposed to remove labour substitution? Does any one know.

    When it was being floated , I knew it will help real applicants like us in the que, but not sure if it became an approved rule.

    We should also ask for it storngly more than ever. I do not think there are so many number of people waiting in the que for so many years.

    What do others think about this.

    Gurus,

    I would like to discuss about changing from EB3 India category to EB2 India category. Currently the PD for EB3 India is somewhere in October 2001. We know people with PD November 2001 to current waiting for GC to get approved. Now the questions I have and topic I would like to discuss are,

    1. Do you guys think that people with PD November 2001 to November 2002 should change the category from EB3 to EB2? (If they are eligible and if they want)
    If you have any reason that these people should stay where they are and wait, please share your opinion.

    2. Do you think that that people with PD November 2002 to November 2003 should change the category from EB3 to EB2?

    3. What about people with PD after January 2004?

    4. Where do we draw the line? We need to help our community to make the best decision on whether to move it EB2 category or stay where they are.

    I would not agree with your interpretation. You are insinuating that a majority of the EB based green cards sponsored by employers are similar to family sponsored green card and also that people are favoured for their nationality....

    The 7% law doesn't take into account the current diversity figure of USA.
    I don't belive Indians and their descendants form a significant majority to affect diversity ( compared to the ones from some of the EU countries and their descendants ) figure.

    For eg. The number of Italian americans is around 16 million , where as the Asian Indian Americans are around 2.5 million.

    Nope. Need 60 votes to do anything in Senate and that is why even though the Dems have a so called majority then cant get anything done.

    However, you need 60 votes to end a fillibuster. A fillibuster is the method used by senators to stall a bill. They will force debate to continue indefinitely. To overcome the forced debate, you need 60 votes (which is what the cloture motion is).

    To pass the bill, only 51 votes are needed. If there is a tie (50-50 or 49-49 or any valid combination), the the Vice President casts his vote to break the tie (and we all know on which side the VP is on)

    Good post. Politics is a game of give and take. One thing legal immigrants should learn is not to distance themseves too much from the cause of illegals. If we support DREAM act, they will support SKIL bill. If we support admission bar repealed or 245(i), they will support higher numeric quotes and not counting of dependents. Think about it, our common goal is the same - to have a fair immigration system, where every desrving person has a chance to come to this country legally and with dignity.

    If we support DREAM act, they will support SKIL bill.

    Who are they?, they do not have any voice or vote anywhere. They are ILLEGAL, they broke the law.

    ... He can veto the immigration reform the Dems propose by saying its not along the lines he wanted it to be. So Rumsfield resignation is a good sign if you look at the over all picture. It also means the Dems are going to spend less time setting up inquiry commitees on everything the President & Republicans have done in the last 6 yrs thus moving forward quickly.

    Senate and President were always supportive of CIR but the House was not.
    Mr. Specter mentioned "... if House members do not like the way illegal immigration was handled, tell us in a conference we will change it...". But the house rejected CIR.
    Please see Rumsfield resignation does not make any difference as far as President's position w.r.t to CIR.

    Most people seem to be in denial...For now they just want to hear that they will be ok...I''m sure we have members whose motherly instincts can kick in. Please help these poor souls...Not sure what else to say...I'm very dissapointed at how much we were able to raise..

    July 2 receipt date is critical for me for AC21 reasons - This is the only reason I am interested to know how they intend to treat cases that were received on the 'day of denial' - not sure why you are interested in polling this thread ???:eek:

    I dont think this bill has or will have any favorable provisions for us unless a miracle occurs.

    I think the tech companies have cut a deal with the Senators through which they will have access to 115,000 H1Bs and more moving forward in lieu of no increase in EB green cards.

    Ask yourself a question. If you were running a big business - whom would you prefer -- GC Employees or H1-B Employees.

    What may be good for us may not be good for the other side.
