I have married my wife last friday. we have been living together for almost two years and own a home together for 6 months. I have been in the stats on A2 visa up until now (3.5 years). I have the doctor's letter on hand and I want to apply for my adjustment of status by early next week. I was told that I will ( MUST LIKELY) receive my I-131 travel document approved in no earlier than 3 months from the time of filling. I have bought tickets to go with my wife to New-Zealand for our best friends wedding on november 5th which means I won't have the travel document on hand in time.
What can I do?

My sponsoring company received an Audit Letter from INS today. Is this the norm in today's scenerio when one applies for labor for a new Green card process?
How alarming is it? What are its effects on Labor application?

I am with H-1 visa. Recently, I help another company finish one project, then I received a stipend of $8K. They will send me 1099 misc form for tax purpose. Does it affect my H-1 status and green card application? Thank you.
Do you have EAD? If not, you may be in trouble as H1 does not allow you to do a side job.

Bottomline - if you are considering converting your LC case from TR to RIR, then your employer must send an email to DOL by Jan 20th and complete recrutiment process by April 1 ( or else case will be closed without recourse to appeal).

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

I have been searching in the inernet for quite some time and looks like
the following questions are still not answered properly. So any of you here who actually used the AC21 in the past can answer the below questions and it will help lot of people on this board.
1) When the employee don't have I-140 receipt number and I-140 approval copy , is it okay to use AC21 after 180 days ?
2) Do we need to have I-140 approval copy for the EAD renewal ?

Hello, my wife and I have been approved and got notice of action (I-797C) in mail May 23 (recieved date May 22). Online USCIS states our cards went into production June 13th and allow 30 days to recieve. We have not moved but will in mid August in order to begin work under OPT. We called USCIS service center on 1-800-375-5283 on 30th day and put in a trace on our cards. USCIS states case will be assigned within 30 days and then expect within 45 days to hear. This is impossible as we hope to begin work before that. I know that calls can be made to get permission to work as we are F-1 graduating Aug 8th BUT need the cards for our bank to approve financing.
Question - is there any way to make direct contact with someone who can tell us the card WAS mailed and provide confirmation. It is odd that regulkar mail delivers such a valuable, time consuming document.
Any comments would be helpful.

It all depends if your I-140 has been filed and approved and the I-485 has been pending for 6 months+.
If your I-140 has been approved and six months have passed since the filing of the I-485 then you should have no problem working in the same/similar job capacity under AC21 provisions.
Having said that, I don't know what the USCIS would do nowadays given the really bad economy.
This is not a professional advice and you should consult a lawyer on your specific case.

I was an employee with company A till march 2008 and i kept a H1b transfer to
company B on march 24th 2008. I was working to company B for an year
on receipt number applied for h1b transfer at USCIS. I got an RFE with
company B in sept 2008 mean while my I-94 got expired on August 2008.
Company B answered the RFE and submitted to USCIS on October 2008.
After waiting for H1B transfer to get approved it got denied on march 10th

Now i wanted to change my status from H1b to F1(CPT). My questions are

My labor was approved Oct,2007 under EB3 (all education from India).
I-140 was applied in May, 2008 and it has been a frustrating 2+ yrs since I have heard anything. Attorney inquired with the USCIS and got a response that it is still under review.
This delay seems to be very unusual. Do you think this delay is due to my education from India only. I have seen folks with Master's degree from US gettting I-140 in 2 - 6 months max. I am worried that this may turn into a denial.
Anyone has similar experiences with education only from India.? Any advice if I should go for I-140 premium processing or wait ?

if filed I think your att. may use PD portability.
If not filed, don't see any reason why he can't straight use the LC of 2003.
