Me and my Wife's i-485 is pening for last one year. EB3-ROW. (PD May 2006). Currently my wife is working with her EAD. Her employer want to apply for her GC also. She will be falling in the EB2-ROW category.
In this situation if she apply for that and take me as a dependent does it going to hurt my current application process? or she can just process her case.
Please respond very urgent

hi,
i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?
thanks for your time,
-andy

not sure what you mean by the words "scrolling from left to right" but I'd be happy to make anything you need as long as it's relatively simple.
Can you discribe in a little more detail what it is you're thinking?

The Comprehensive Immigration Reform bill introduced in the House of Representatives would revamp the existing employment-based (EB) preference system in a number of important ways: 1) Recapture Currently, 140,000 persons are permitted to immigrate to the U.S. each year under the EB preference system. If less than 140,000 visa numbers are given out by the end of the governments fiscal year on September 30, the remaining numbers are essentially thrown away. As a result, in most years, 20,000 to 30,000 visa numbers are lost. The bill would change this system so that whatever EB visa numbers are remaining at...

Thanks for posting the link. It clears up a lot of questions and doubts members were having regarding disciplines which fall under STEM.
I found a list of STEM disciplines on DOL's O-NET website.

Some offbeat occupations that are considered STEM -

My first H1 was from "Company A" back in 2001. Company A also sponsored me for my green card. In 2005 I transferred my H1 to Company B, however my green card was still sponsored with Company A. I have an approved I-140 and I am waiting on my PD to become current. My H1 is suppose to get renew in August of 2007, which will be through Company B.
I have heard that after 6 years renewal, your current H1 company should have sponsored you for green card in order to get the 7th year H1. And as you can see in my case that my previous company has sponsored me for my
H1 and not my current company.
Can someone put some light on this issue.
Thanks,
SHA

conservative columnist and former Bush speechwriter David Frum would like to see three more concessions on the DREAM Act to get conservatives to agree to the bill - http://andrewsullivan.theatlantic.com/the_daily_dish/2010/12/middle-ground-on-dream.html: Here would be my three main suggestions: 1) Lower the age of entry into the US. Even the new versions of the law extend amnesty to people who entered the US up to age 16. That allows too many people who entered on their own impetus rather than as part of a family group and too many people whose first language will never be English. Id lower to 12, to...

I usually use this space's real estate to criticize the tactics of the antis. But I'll give them some credit for the extremely effective job they did during the first two rounds of immigration reform earlier this decade. That was largely because of a well organized grass roots effort that left the pro-immigrant forces in the dust. The Reform Immigration For America coalition has sought to help the pros get caught up. And they are starting to show real muscle. Last night, an estimated 60,000 people participated in 1000 house parties across the country where they listened in to a...

When I was in law school at the University of Chicago, our economics-oriented professors would often refer to "widgets" when they needed to refer to an unnamed manufactured object. A widget is really an "any object" that is interchangeable with other widgets. The idea is that you can focus on broader economic principles if you can keep the student from focusing on the particulars of a given industry. And despite a stated concern for workers, Senators Bernie Sanders (I-VT) and Charles Grassley (R-IA) really think of workers as widgets - interchangeable cogs in the world of business. They are proposing...

I was working for company A in US till June 2008. I had to return to India in July 2008 due to personal reasons. My 6th yr on H1b expired in October 2008.
I am now in India and applying for 3yrs H1b extension based on my approved I140 with company B. My I485 was filed in august 2007. I do not have US pay stubs since July 2008 as I did not work in US.
Has anybody been in a similar situation? What are the chances of getting approval? Once I get I797 approval, should I expect further challenges in getting visa stamped in India?
thanks

A fat report and one with some helpful recommendations and statistics. Here are some of the more interesting items I found - - Of the top 150 H-1B employers, 24 were deemed H-1B dependent (a high percentage of workers on the H-1B) and 9 had prior H-1B violations. - Real earnings growth for US workers in occupations with proportionately more H-1B workers - particularly IT - was actually much stronger than the general US worker. - Engineers and IT professionals on H-1Bs were more than twice as likely as their US counterparts to have advanced degrees. - The proportion of...

A kind reader sent me a link to a new Business Week article that discusses a fast emerging trend in American business schools - taking jobs in Asia rather than in the US. One of the biggest targets - young Asian immigrant students in the US being lured back home: How much longer can the Asian allure hold? With protectionist talk rising in America, and China trying to put the brakes on its rapidly growing economy, there's always a chance that Asia could stumble. There's also rising concern about what the migration East might mean for the U.S.'s competitive edge....

I have a approved I140 from my current employer with prority date of may 2006. I had applied a labor long time back in Jan 2004 with another employer. This labor is approved now. Can I apply another I140 with the old empoyer without revoking the one that I have with the current employer as I want to stay with the current employer till I get the new I140 approved? Will applying the I140 with the old affect my current I140 approval.
Please help, I have to decide soon.

I am currently waiting on my 485 (EB2). My priority date is Sept 16 2005, and 485 date is Aug 27 2007. I have traveled out of the country and back on advance parole and am still on H1 as I am still with the same company. My current advance parole ends in Jan 31 2010. I have to travel again in the first week of Feb 2010. I applied for another advance parole at the TSC on Aug 31 2009 for both my Wife and I. My Wife got her parole in a week, but I am yet to receive it.
I checked the USCIS site for the time frame and it says 3 months for TSC. I am thinking I might not have received it yet as I have a parole which is active. But I want to make the travel reservations now and I wanted a confirmed parole. USCIS said that they could put in an expedited request for the parole if it is an emergency. My lawyer says not to worry as I had applied in August, I had plenty of time to receive it.
Please advice. What should I do.

Hi All,
I have come across situation where people who primarily filed 485 to NSC and their cases have been transferred to Texas or other places. In their notices the receipt date has been mentioned as the date on which the case received later by another service(TSC, CSC etc) center and not the date on which the case was first received by NSC.
So technically it is not the fault of the applcant and in some cases they lose 3 or more months for AC21.
Can someone or moderators explain if one can argue with USCIS to put the receipt date as the original for AC21 considerations.
Thanks & Regards
