My sister's H1B petition was approved on 2008 and she was unable to travel US for the past 1.5 year.
She is working in a MNC company in India. Now, she came to US on her B1 visa 1.5 month back. Meanwhile, she got an offer from a client in US and she want takeover the new job on her approved H1.
So, can you please let me know whether the employer (whoever filed my sister's h1) can file the H1B amenment while she in US with B1 visa and having H1B approved petition? If so, how many days she has to wait to get the approved amenment to start her work at client place? The employer is going to do the premium payment so that can we assume the amenment will be approved for sure?.
The LCA is really required for H1amenment? Please advice. This is really urgent.

My wife got her H1B approved couple of months back (Sep 2008). She did not get a job till now (Nov 2008) due to the market conditions. We need to travel to India early next year and have to do visa stamping.
1. Can she go back on her H4 and then go to India and get it stamped? She had been on H4 since Oct 2003 up until Oct 2008 (when her H1 became valid). If she goes back on H4, how long will it be for? Does her clock for 6 years of H4 start again after this change back from H1?
2. Once she comes back from India, can she look for a job and get back on the same H1? Will she be required to go through the cap? How much time will be remaining on her H1 (6yrs - 2 months that she worked)?
3. Please advise if there are some other options to keep the H1 (do not want to go thru the cap again) but not getting it stamped when in India. If we get paystubs from the employer for some months on H1, will that help?

So, I called USCIS this morning. The lady at the other side of the line told me that I have to reapply, and unless I have a real emergency (as defined by USCIS), I have to wait for another 6-8 months for the AP to be reissued.

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service. ABC News has an interesting piece that discusses the birth tourism controversy and quotes a statistic that actually comes from Lindsey Graham's office. According to the National Center of Health Statistics, just 7,760 mothers report that they live outside the US of more than 4,000,000 births each year. Keep in mind that some of these mothers are actually US citizens who reside abroad but want to have their children in the US. So we're really talking about less than .2% of all births as being this huge problem that suddenly justifies overturning the 14th Amendment.

Call Customer Service. Phone no. is provided on any of your recipt notices. These is an option for typos on the document, when you call them. Tell them and they will open a Service Request, and update your name either when you go for fingerprinting or immedately. Mostly, they will open service request. You should also get an email confirming the Request made by you within few days (When I called for my typo, they said witin 45days, but got the mail within 15 days). Take that email with you if you get it before fingerprinting.

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. That's roughly the typical weekly usage we saw last year and if the pace doesn't change much, the cap will potentially be hit one to two months later than for FY2011. Hello Everybody. I am new to IV. Recently I have filed my wife's I-485 (06/28) after my I-485 approval on 06/18. My lawyer said that he has filed it by using the "Follow to join" benefits. He is saying that he cannot guarantee that USCIS will accept the I-485 since my I-485 is already approved. He said that we just have to wait and see until the receipt notice is issued.
Is anybody else in similar situation? Also does any one know what kind of documentation and cover letter needs to be included for this kind of case? I have asked him if he has included the I-485 approval notice and he said "No".

I am not sure if it was posted before, the immigrant visa fee will go up to $400 from $380 effective January 1, 2008.
Also, Bombay and Madras consulates switched to NVC appointment processing (NVC takes over the scheduling of immigrant visa appointments). Delhi and Calcutta are still standard processing posts, but expect them to be converted in the near future as well.
Chinese, Japanese, Australian and some other (mostly Asian) consulates still follow standard processing, but expect them to be converted in 2008 as well.
They convert consulates without any notice to the public, so always check here before sending in DS-230 and supporting documents:

My friend is an F1 student (citizen of India) who has been in the US for 3 years as a grad student. She has paid US taxes on stipend/fellowship received from US university while pursuing grad studies (filing taxes as a non resident in US, since the first 5 years on F1 are not counted towards substantial presence test).
Does she need to also pay taxes on this stipend in india, or report this income in india? AFAIK, no taxes need to be paid in India on this US stipend, but I couldnt find any authoritative reference online.
Am asking, since someone I know recently got a letter from IT dept in india saying that the US authorities reported $10K of income when that person was a student (this was a fellowship from the university) - and the letter goes on to ask the person to meet someone at the indian IT department.

You must submit the 485 through a lawyer if your priority is current, check the visa bulletin. You can always file when 140 is approved and you are still employed with same employer. You can also file EAD & AP for work permit and international travel. Get a lawyer asap.
