Hi ,
My wife has H1 visa approved under Consular Processing from Company A, so she is still under H4. She got another offer from Company B so we applied for another H1B before H1B quota expired. It is under process.
1 ) we applied for COS from H4 to H1 By Company A by premium processing.
2 ) Company B H1B from H4 is also under process.
Does the order of outcome from either petetions affect another petetion. For example if companie A petetion is approved and then afterwards company B petetion is rejected. will she be in H1 status.

And is part of Immigration Reform Bill (part of reform for illegal people); considering fact that Health Care opposition, election year, 10% unemployment & other unknown factors; I do not see any hope of changing law for employment base (no hope for visa recapture).
Do seniors or admin team see any hope for EB3 candidate?

Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.
The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.

I've looked in the forums but haven't been able to find an answer for my question. Here's my situation:
EB3 I-140 pending under "Software Engineer" position. 485 has already been applied.
I would like to start a EB2 PERM for a "Senior Software Engineer" position.
Would this constitute a conflict of interest and jeopardize my EB3 140 resulting in a denial?
PS: The intent is to interfile when applying for EB2 140.

hi folks,
I need some help wrt my wife's immi status.
She had applied H1 (from H4), and got the approval notice I-797.
Now, we applied I-485 for both of us on July 1st
But our attorney did not file for EAD/AP, because of time constraints.
Is it ok for her to start working using the H1 from Oct 1st?
Will it jeopardize her I485 Appln?
Any info / experience on this will be of great help.

Hi guys,
MY H1b extn is due in November.But as my marriage will be in May or June i need to go to india.My employer says he can file h1 Extn only before 6 months of expiry.
My question is cant he file for H1B extn before 6 months.
Can I file for extn and leave to india while H1 extn is under process.

Filing campaign finance reports electronically has been standard operating procedure for candidates for the House of Representatives and the White House for years -- as it has been for political parties, political action committees and "527" groups. Yet Senate candidates are still trudging down to the Senate Office of Public Records with paper copies of their reports, which are then passed along to the Federal Election Commission, which sends them to a vendor that punches in the information and zaps it back to the FEC electronically. That finally makes them widely available, sometimes too late for voters to see who's donating to whom and how the money is being spent. With this seeming fear of modernity, it's a wonder the Senate isn't calculating budgets with an abacus. Or is it a fear of disclosure?

Long-standing Senate custom allows the objection of a single senator to stop a bill in its tracks -- it's known as a secret hold. A measure that passed the Senate earlier this year, and awaits a House vote, would eliminate the practice.
The hold unleashed a torrent of activity on the Internet, as bloggers tried to flush out the identity of the senator responsible for the hold. But after an onslaught of phone calls to Senate offices, the bloggers have no answer. No one owned up to being the culprit.
Yesterday, the bill's sponsor tried again. And again, the Republican floor leader objected. A spokesman for Senate Minority Leader Mitch McConnell (R-Ky.) said he is sure the name of the secret senator is known "in the cloakroom," but he said that misses the point.
"A hold can't stop something from coming to the floor," Don Stewart said. "It can only stop it from being pushed through without a full and open debate on the bill."
That's true -- sponsors had been trying to pass the bill by unanimous consent, which does not permit amendment or debate. But Feingold told the liberal blog Daily Kos that the path was typical for a bill with 35 bipartisan co-sponsors that did not elicit a single objection in committee.

Due to a sudden demise of my wife's grandmother, my wife had to go to India last week. She is planning to come back by Nov. 15. I received the receipt notices for my wife's I-485, I-131 and I-765. My question is if the fingerprinting notice comes before she arrives and also if it is scheduled prior to her arrival date on Nov. 14; what are the options of rescheduling and can we get the date of our choice after Nov. 14. Also, I would be extremely grateful, if someone could upload a sample fingerprinting notice from USCIS. I couldn't find any where on the site.

Here is a question for one of my friend
He is a July 07 filer and has I 485 pending for more than 180 days, has EAD and AP.
All through the years he has been on H1. however there is a gap of 40 days between change of employer on H1. (The H1 is approved after this gap of 40days) Is he in the status during this gap of 40 days because he has pending 485 and has valid EAD/AP?

My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

I filed concurrently I 140 and I 485.
My application has been transferred from California to Nebraska.
I wanted to check if folks have seen any updates on thier cases.
I noticed on the website, for my I 140 status it does not show any date etc, it simply says case transferred to a USCIS office. For some folks it shows on a specific date..XX XXXX we recd your case at this office..
Can we all share our data under this thread for I 140 filing with 485 on July 2.

I think I know the answer to this, but I just wanted to make sure from the experts on this forum.
Do we need to apply for new EAD/AP if we change jobs using AC21 even if the current EAD/AP (approved when working for the GC sponsoring employer) are valid for almost 10 more months?
I think that EAD/AP are not dependent/tied to the employer.
Am I right gurus?

I am using Advance parole in december to visit India. I have applied my canada PR in 2008, but I don't have stamp of PR in my passport.

I requested for a document that got returned as undeliverable to be resent.
I first requested CSR and she gave me a referrral#.
Same day I spoke with IIO and she made the request again for me(before I could tell her I spoke with CSR)
Today I spoke with a CSR and gave her the referral# that the CSR gave me last week and this lady says she didn't find any information related to this referral# .She did say it does surprise her. She also said she will open a new request .
I was concerned if that will be kind of duplication of the work done by CSR & IIO last week and she said there is no need for such concern.
What does all this mean?
They open a request , give you a referral# and tell you the document will get mailed in 3-5 business days .
IIO says she has placed a request.
You go back after a week , and referral# has no information attached to it and this CSR says she 'll open new request.
Anybody has any idea?
