My PD is Jun 2008 and my I140 is approved in April 2009 in EB2. My employer and lawyer did not give me any paperwork regarding Labor or I140 so I know details about Ad, Job Title or Description and stuff like that. If I want to transfer my H1 and keep the Priority Date, how can I know these details. Will it be a problem if I dont have these details.

Any advantage of opening an account on USCIS website to receive automatic case status updates? or I don't need to do that if I keep checking the status online by myself?
They send you and email if something changes, nice if you have a Blackberry/pda
If you have multiple cases i-129, i-131, i-140, i-485 you can see them all on one page, I find that easier to see LUDs in particular the "soft" non-action ones, but it's nice to know the file was touched.

Is my birth certificate needed to invite my parents on visitor visa? Isn't my SSC certificate showing date of birth and both parents name enough?

I have neither received a receipt nor checks have been encashed. My attorney has not received any july 2nd filed cases receipts. Its a pretty big law firm.

Recently I filed a H1-B Part time Visa. I received the notice from the Lawyer that my application got a RFE on it.
Will they usually show the status online? When I check USCIS, it does not say my case had a RFE on it.

Guys,
I filed our AP & EAD on August 10th with proof of 485 filing/delivery confirmation.
We got our receipt notices for AP 131 but unfortunately they have rejected our EAD 765 for incorretc filing fee of $180.
They written a notice saying the correct filing fee after July 30th is $340.
But for July VB is'nt the filing fee $180?
I have got back my entire documents packet for 765.
What should I do now? Should I resend the packet with a letter saying that I come under July VB? or should I send a new check for $340? Anybody gone thru similar experiences? Pls help.

Hi,
I applied for my wife's AP online & while entering her SSN there was a typo (wrong digit entered).
What will happnen to the application? will I get RFE? or should I send letter addressing the issue with copy of SSN card along with copy of receipt?

Hi,
I am in 7th year of H1B which expires in Dec 2011. I-140 is approved. Applied for H1B extension in Oct2010 (after 6 yrs completed) based on approved I-140 but got extension for only 1 yr till 2011 (got client letter for 1 yr only) . Can i transfer my H1B to new Employer based on my approved I-140 from my current Employer? If so, can i get 3 yr extension with the new Employer or will the new H1B be valid only till 2011?

EB-485 processing times in NSC is FOUR (4) Months for the visa number available cases, and also pending EB-485 cases whose visa numbers are current and ready to adjudicate . So does this mean that cases with PD's not current but ready to adjudicate will get their I-485 approved by 6 months . Can some one please break it down for me .

Hi all,
I'm on my 5th year of H-1b visa. I had my I-797 approved until 10/30/12. My old passport was due to expire on 2/25/11 so during my recent trip my I-94 was given until 2/25/11, even though my visa is until 10/30/2012. So my lawyer filed I-539 to get a new I-94 on 2/20/11. I still didn't get my case number yet. Now I have another Job offer and the new company's lawyer says that i cannot take another job until this case is complete. I'm totally confused and not sure what to do. Please help. your help is very much appreciated.

I will be appearing for L1 individual visa extension in chennai in a few days from now.
One the questions that would be asked by the VO would be "where and who do you work for". The second part is easy since i work for the petitioning employer rendering my services for their client. However for the first part of the question what appropriate answer can be given?
Can i mention the client name location in US since that is where i currently work although i am controlled by the petitioning employer. I would not be working from the petitioning employer work location in US. I believe the L1 Visa reform act of June 2005, tells that you can work from offsite location provided you are controlled/managed by petitioner.
Please advise as it would help me in responding with correct answer. Thanks.

My husband has a conviction for domestic violence. he was not jailed but is under probation. he is on h1b visa and i am on h4. his i140 was approved before the conviction. also both our visa extension were approved prior to that. currently visa stamp in both our passport has expired but we have valid i-94. i need to visit india for urgent family health issue. if i go i will need to get a new stamp. Can his arrest result in my visa getting denied at consulate. Or will it create any problems for me at port of entry?. he is not going to travel with me

My H1 is expiring Jan'2011 with company A and company A has not filed my labor yet due to economic slow down.
As an employee of A, I have been working hard about 10-12 hrs day for last 3 years, and now they are saying they cannot file my labor.
Since, I'm not sure, if they will file my labor, I applied for h1 transfer in aug 2008 to company B but have not started working to company B.
I'm still working for company A, now that company B is willing to file my labor & 140 asap.
Now, If I move to company B and start working, what would be the chances of getting my labor approved through company B, I have been working here in US for last 5 years with great job history and tax history.
